HTC One X and HTC EVO 4G LTE- US shipments get delayed for Apple patent violation

HTC has been going through some difficult time in its patent war against Apple, and recently the company took another blow when the US customs office indefinitely delayed the launch of two major HTC devices for the US market. These devices happen to be HTC One X for AT&T and HTC EVO 4G LTE. As per the details, the launch of these devices has been delayed because they supposedly infringe upon the Apple’s patent #5,946,647. This has resulted from an exclusion order which Apple won against HTC in December last year at the International Trade Commission. According to this decision by ITC, the messaging app and browser of these devices infringed upon Apple patent which is related to the conversion of phone numbers and email addresses to links. However, according to the tech experts, the models of these devices that are specifically aimed for the US market do not really infringe upon these rights since there is considerable difference between the models for international market and those for the US market. Initially, the ban was delayed so that HTC could alter the design of the components that caused this problem. Eventually it went into effect starting from April 19.

This ban imposed by ITC applies on the importation of any Android based device form HTC. The ban is being supervised and implemented by US Customs and Border protection. So far the launch has been delayed indefinitely and it is not know what the outcome of this scenario would be.

According to the official announcement made by HTC, HTC One X and HTC EVO 4G LTE have been delayed for the US market after a standard U.S. Customs review of shipments. HTC believes that this ban is not just since the company is in complete compliance with the ruling and no patent right has been infringed upon. HTC has been in negotiations with the customs office to get the approval for the releases and the company has said that these devices would soon be made available and customers would not have to wait for too long. HTC has also denied that any patent infringement has taken place since the design of the devices has been modified for the US market.
